Introduction

These Terms of Service set forth the conditions for using DAY100. Kuuma Inc. provides DAY100. By downloading or using the app, you are deemed to have agreed to these Terms.

Service Description

DAY100 is a tool designed to support habit formation by providing habit tracking, visualization of continuity status, reminders, widgets, app blocking, cloud storage, transfer codes, image and PDF exports, and time-lapse videos with optional background music.

Terms of Use

1. Age Requirement: The app is intended for users 13 years of age or older.
2. User Responsibility: Users shall use the app at their own risk.
3. Prohibited Actions: Misuse of the app, reproduction, modification, reverse engineering, infringement of third-party rights, and other acts that violate laws or public order are prohibited.

Data Handling

Habit data and related information are primarily stored on the user’s device. When users use cloud storage or transfer code features, habit records, notes, image references, uploaded images, anonymous identifiers, and synchronization data may be stored or processed through cloud services in order to provide those features.

Cloud operations may run automatically when Firebase is available: the app signs in anonymously during startup, may upload existing local photos, backs up habit data when records are saved, and may upload newly added photos. These operations are not limited to manually creating a transfer code. An anonymous user ID does not mean that the linked photos or notes cannot identify a person.

Transfer codes are issued for moving data to another device, expire after 24 hours, and may replace the current device’s habit data when redeemed. Please refer to the Privacy Policy for details on how user data is handled.

Premium Subscriptions

1. DAY100 may offer paid premium features, including additional habits, multiple Extreme Mode habits, premium widgets, additional daily photos, watermark-free image/video exports, aspect-ratio options, and additional background music. Available features and limits are shown in the app before purchase.
2. Subscriptions may be provided as monthly or yearly auto-renewing plans. Payment, renewal, cancellation, and refund handling are managed by the App Store or Google Play account used for purchase.
3. Users can cancel subscriptions through the relevant store account settings. If a subscription is cancelled, premium features remain available until the end of the current paid period.
4. Prices, plan names, and available premium features may change as necessary. Any store-side purchase terms also apply.

User Content, Exports, and Background Music

Rights in photos, notes, and other content provided by users remain with the user or the original rights holder. Users must have the rights or permissions needed to record and share that content. We process it to provide storage, backup, transfer, and export features; using DAY100 does not transfer ownership of user content to us.

Users may save, print, and share exported images, videos, and PDFs. Users may include background music made available to them in DAY100 in videos exported through the app and share those videos, including on social media. This does not transfer ownership of the music or grant rights to distribute the music as a standalone audio asset.

Export conditions, photo limits, watermarks, aspect ratios, and available music depend on the feature and plan shown in the app. Time-lapse export requires 30 days of records with photos. Exports may use a selection of recorded photos and are not a complete backup of all original files.

Before sharing, users should check the export and the destination, including any photos, names, dates, or notes they do not wish to disclose. Shared copies are handled under the recipient’s or destination service’s rules. Platform compatibility and uninterrupted playback or publication on every third-party service are not guaranteed.

Intellectual Property Rights

Copyrights, trademarks, and other intellectual property rights related to the app belong to Kuuma Inc. or their respective rights holders. Users receive only a non-exclusive right to use the app.

Service Changes, Suspension, and Termination

Kuuma Inc. may change the content or functions of the app without prior notice. Kuuma Inc. may also temporarily suspend or terminate the app for maintenance, force majeure, or other cases deemed necessary.

Disclaimer

1. Kuuma Inc. does not guarantee the accuracy, usefulness, or completeness of the app.
2. Liability for damages is determined by applicable law, including Japan’s Consumer Contract Act. These Terms do not exclude or limit liability arising from our intentional misconduct or gross negligence, or other liability that cannot lawfully be excluded or limited.
3. The app is provided as is to the extent permitted by law. Nothing in these Terms overrides mandatory consumer rights.

Changes to the Terms

Kuuma Inc. may change these Terms as necessary. Changes will be made in accordance with applicable law. We will announce the content and effective date through the app or related website, and obtain consent where required by law.

Governing Law and Jurisdiction

These Terms are governed by Japanese law. Disputes related to these Terms shall be subject to the exclusive agreed jurisdiction of the courts in Japan.

はじめに

本利用規約は、株式会社クーマが提供するDAY100（以下「本アプリ」といいます）の利用条件を定めるものです。ユーザーは、本アプリをダウンロードまたは利用することにより、本規約に同意したものとみなされます。

サービスの内容

本アプリは、習慣形成を支援するためのツールです。習慣記録の管理、継続状況の可視化、リマインダー、ウィジェット、アプリブロック、クラウド保存、引き継ぎコード、画像・PDFの書き出し、BGMを付けられるタイムラプス動画の作成などの機能を提供します。

利用条件

1. 対象年齢：本アプリは13歳以上のユーザーを対象としています。
2. ユーザー責任：ユーザーは、自己の責任において本アプリを利用するものとします。
3. 禁止事項：本アプリの不正利用、複製、改変、リバースエンジニアリング、第三者の権利を侵害する行為、その他法令または公序良俗に反する行為を禁止します。

データの取り扱い

本アプリで作成された習慣データや関連情報は、主にユーザーのデバイス内に保存されます。クラウド保存や引き継ぎコード機能を利用する場合、習慣記録、メモ、画像参照、アップロードされた画像、匿名識別子、同期に必要なデータが、機能提供のためクラウドサービス上で保存または処理されることがあります。

Firebaseが利用できる環境では、起動時の匿名認証や既存の端末内写真のアップロード、記録保存時の習慣データのバックアップ、写真追加時のアップロードが自動的に行われる場合があります。これらは、ユーザーが手動で引き継ぎコードを発行した場合だけに限りません。匿名ユーザーIDを利用していても、紐づく写真やメモの内容が個人を特定できないことを意味するものではありません。

引き継ぎコードは、別の端末へデータを移すために発行され、24時間で期限切れになります。引き継ぎコードを利用すると、現在の端末の習慣データが引き継ぎデータで置き換わることがあります。ユーザーデータの詳しい取り扱いについては、プライバシーポリシーをご確認ください。

プレミアム機能とサブスクリプション

1. 本アプリでは、習慣数の追加、複数の鬼モード、プレミアムウィジェット、1日の写真枚数の追加、画像・動画のウォーターマークなしの書き出し、比率の選択、追加BGMなどの有料機能を提供します。利用できる機能と上限は、購入前のアプリ内表示をご確認ください。
2. サブスクリプションは、月額または年額の自動更新プランとして提供される場合があります。支払い、更新、解約、返金は、購入に利用したApp StoreまたはGoogle Playのアカウントを通じて管理されます。
3. ユーザーは、各ストアのアカウント設定からサブスクリプションを解約できます。解約後も、現在の有料期間が終了するまではプレミアム機能を利用できます。
4. 価格、プラン名、提供されるプレミアム機能は、必要に応じて変更されることがあります。また、各ストアが定める購入条件も適用されます。

ユーザーのコンテンツ・書き出し・BGM

ユーザーが提供する写真、メモ等の権利は、ユーザーまたは元の権利者に帰属します。ユーザーは、記録・共有に必要な権利や許諾を得た内容を利用してください。当社は、保存、バックアップ、引き継ぎ、書き出し等の機能提供のためにこれらを処理します。本アプリの利用によって、ユーザーのコンテンツの権利が当社に移転することはありません。

書き出した画像、動画、PDFは、保存、印刷、共有できます。アプリ内で利用可能なBGMは、本アプリで書き出す動画に組み込み、その動画をSNS等で共有する目的で利用できます。BGMの権利がユーザーに移転するものではなく、音源単体の素材としての配布を許諾するものではありません。

書き出し条件、写真枚数、ウォーターマーク、比率、利用可能なBGMは、アプリ内に表示する機能・プランの条件に従います。タイムラプス動画には写真つきの記録が30日ぶん必要です。書き出しには記録した写真の一部を使用する場合があり、すべての元ファイルの完全なバックアップではありません。

共有前に、公開したくない写真、名前、日付、メモ等が含まれていないか、共有先と内容を確認してください。共有後の複製物には、受信者や共有先サービスの規則が適用されます。すべての外部サービスでの再生・公開や互換性を保証するものではありません。

知的財産権

本アプリに関する著作権、商標権、その他の知的財産権は、株式会社クーマまたは正当な権利者に帰属します。ユーザーは、本アプリを利用する非独占的な権利のみを有します。

サービスの変更・中断・終了

株式会社クーマは、ユーザーへの事前通知なく、本アプリの内容や機能を変更することがあります。また、保守・点検、不可抗力、その他必要と判断した場合に、本アプリの提供を一時的に中断または終了することがあります。

免責事項

1. 株式会社クーマは、本アプリの正確性、有用性、完全性について保証するものではありません。
2. 損害賠償責任は、消費者契約法その他の適用法令に従います。当社の故意または重大な過失による責任その他法令上免除・制限できない責任を、本規約によって免除・制限するものではありません。
3. 本アプリは、法令で許される範囲で現状有姿で提供します。本規約は、法令によって認められるユーザーの権利を妨げるものではありません。

規約の変更

株式会社クーマは、必要に応じて本規約を変更することがあります。変更は適用法令に従って行い、変更内容と効力発生日を本アプリ内または関連ウェブサイトで周知します。法令上同意が必要な変更については、必要な同意を取得します。

準拠法と管轄裁判所

本規約の解釈および適用は日本法に準拠するものとし、本規約に関連する紛争については、日本国内の裁判所を専属的合意管轄とします。
